A Federal High Court sitting in PortHarcourt on Tuesday struck out the suit filed by Peoples Democratic Party,PDP against Chief Dumo Lulu Briggs, the Governorship candidate and National Assembly candidates of Accord,A.
Justice Stephen Daylop-Pam in his judgement found merit in the preliminary objections raised by Counsel to Accord Governorship and National Assembly candidates struck out the suit filed by PDP for lack of jusrisdiction .
Speaking outside the court room,Counsel to the Governorship and Assembly candidates, Benjamin Omaje Esq explained it is a victory for Accord A.
Omaje explained that in the 211 matter, that is for the Governorship matter,the court upheld the preliminary objection filed by Counsel to the Governorship candidate, saying that the court has no jusrisdiction to entertain the matter.
He said they raised several grounds upon which include that the matter was filed out of time by PDP and it is an intra party affair,no party,nobody has the right to interfer .
Omaje disclosed that the court based it judgement on the decision of court of Appeal Lagos Division which recently came out and was submitted to the judge in the matter that nobody has the right to question the internal activities of Accord A and it was based on that,the court made its decision.
On the second matter,the Counsel to the National Assembly candidates said they also filed preliminary objection and court also agreed with them and upheld all the issues on the Preliminary objection raised by Accord, National candidates and struck out the suit filed by PDP .
Meanwhile one of the Counsel to PDP Dike Udenna Esq told the Judge that naturally they were unhappy about the Judgement but that is the Judgement of the court for now.
Reacting to the ruling,Governorship candidate of Accord,A Chief Dumo Lulu Briggs said it is an internal affairs of a political party which nobody in that party is questioning how the candidates emerge.He said Justice has been served.
He noted that it is in the same manner next year,Rivers people will deliver judgement in my favour.
