NBA Benin Condemns The Prolonged Detention Of A 10 Year Old Child By Edo State Police Command

The Human Rights Committee of the Nigerian Bar Association (NBA), Benin Branch (Lion Bar), expresses deep concern over the continued detention of Master Bright Wana, a ten-year-old child by the Edo State Police Command since the 23rd of January 2025.

Despite interventions by the Chairman of NBA Benin and members of the Human Rights Committee, the minor remains in custody without bail, and the police have yet to charge him before a competent court of law.

This case underscores the urgent need for greater adherence to constitutional safeguards protecting children’s rights in law enforcement procedures. The detained child has already given a statement to the police, denying involvement in the alleged offence, yet remains in detention with adult suspects on the directive of the Commissioner of Police.

The Nigerian Constitution and other applicable laws provide clear guidelines on the rights of minors in conflict with the law, including the right to bail and timely arraignment. It is therefore imperative that the police, as enforcers of the law, uphold these legal standards.

We call on the Edo State Police Command to either release the minor on bail or promptly charge him before a competent court in accordance with due process. We also urge all relevant stakeholders to intervene to ensure that justice is served in line with the rule of law.

The NBA Benin Human Rights Committee will continue to monitor this matter closely and take all necessary legal steps to safeguard the child’s rights while keeping the public informed of further developments.
